City council closed public hearing on Rodeo Master Plan (vote scheduled October 13th) and approved Sierra Point LLC's 73-acre land donation for airport safety purposes.
Prescott Council Closes Rodeo Master Plan Public Hearing, Accepts 73-Acre Airport-Safety Donation, and Confronts State Preemption Threats
On September 22nd, Prescott's city council advanced three substantive items: it formally closed the public hearing on the Rodeo Master Plan after a second round of community input integration, setting a final vote for October 13th; it unanimously accepted a 73-acre land donation from Sierra Point LLC to buffer the airport's crosswind runway from development and safety hazards; and it heard briefings on Gold Paradise Mine environmental remediation and state legislative efforts to curtail local land-use authority. The meeting underscored tensions between community engagement, federal/state compliance, and fiscal pressures facing Arizona municipalities.
Key Speeches
"We were working on the rodeo master plan. We've had public hearing process. Um this is the second public hearing and given all the input that has rolled in since our August town meeting um at the roster center all the way through now the rodeo uh steering team and GH2 has been integrating input and making little bitty adjustments but this was the final part of the formal public hearing." — Mayor Pro Tem Lois Fruhwirth
"We did hear some issues or concerns were expressed yesterday by uh some members of the community and the public um and the neighborhood. Um, some of those issues and concerns are things that frankly we'll have to uh address as part of the lease negotiations." — Mayor Pro Tem Lois Fruhwirth
"So yesterday the great news was that uh Sierra Point LLC um did donate uh 73 acres to the city of Prescott. We not only accepted the donation, but we also approved adopting that land um into the airport master plan and into the airport area. And that's really important from all sorts of federal government related reasons to have done those things." — Mayor Pro Tem Lois Fruhwirth
Timeline

Opposition
The brief analysis and transcript do not provide a detailed breakdown of opposition speakers or specific arguments raised against the Rodeo Master Plan during the September 22nd hearing. Lois Fruhwirth acknowledged that "issues or concerns were expressed yesterday by uh some members of the community and the public um and the neighborhood," but she did not enumerate them in the recap. She noted that "some of those issues and concerns are things that frankly we'll have to uh address as part of the lease negotiations" and that "some of those concerns are something that I thought yes needed to be integrated um into the master plan." The nature of these concerns—whether related to traffic, density, design, parking, environmental impact, or lease terms—is not specified in the available materials. The deferral of resolution to lease-negotiation phase suggests contentious items remain unresolved.
Support
No organized support or public advocacy for the Rodeo Master Plan is detailed in the transcript. The master plan appears to have been developed through an extended steering-committee and public-engagement process (August town meeting, ongoing public comment) under the direction of planning firm GH2, suggesting a collaborative design methodology. Sierra Point LLC's land donation was characterized as "great news" by Lois Fruhwirth, but no external stakeholder support is documented.

Outcome & Next Steps
Rodeo Master Plan: The formal public hearing phase is now closed. The city council has scheduled a vote on the final master plan for Tuesday, October 13th, 2026, at 3 p.m. Public comment will be allowed at that meeting. Between now and October 13th, the steering team and GH2 will finalize any master-plan language refinements and begin preparation for lease-negotiation phase, during which specific community concerns raised during the September 22nd hearing will be addressed. Lois Fruhwirth did not specify whether material changes to the master plan document itself would be made or whether concerns would be resolved primarily through lease terms.
Sierra Point LLC Land Donation: The 73-acre parcel is now formally conveyed to the City of Prescott and has been adopted into the airport master plan. The donation expands the public-safety buffer around the crosswind runway, reducing the risk of unauthorized residential development in the aircraft crash zone. No further council action is required for this item.
Gold Paradise Mine Remediation: ADEQ will continue to oversee environmental cleanup at the Hyia River site. The $4 million contingency fund held by ADEQ provides assurance that if Gold Paradise Mine fails to complete remediation obligations, the state has resources to finish the work. The City of Prescott will assess options to protect city road infrastructure (particularly from heavy mining trucks) should the mine resume operations. Additional forums and updates will be conducted by the county and other agencies; council will monitor developments.
Legislative Platform & State Preemption: The city has adopted a simplified two-page legislative platform outlining fiscal 2027–2028 or 2028–2029 priorities, available on participate.prescott.gov and the city website. Council will continue to monitor and respond to state legislative efforts that may further preempt local land-use authority.
Controversies & Context
Rodeo Master Plan Community Concerns: While the transcript does not itemize specific objections, Lois Fruhwirth framing indicates that community members and neighborhood representatives raised material issues during the second public hearing. Her decision to defer resolution to the lease-negotiation phase—rather than integrate them into the master plan itself—suggests either (a) the concerns were operational or financial in nature, not design-related, or (b) the council determined that lease terms offered a more flexible vehicle for addressing community demands than a locked master plan. This deferral strategy may satisfy or frustrate various stakeholders depending on their trust in the lease-negotiation process.
Gold Paradise Mine Environmental Legacy & Road Infrastructure Risk: The Gold Paradise Mine presents a two-phase risk profile for Prescott. First, ADEQ has already required environmental remediation at the Hyia River following mining operations conducted under prior ownership. The $4 million contingency fund signals that ADEQ acknowledges potential non-compliance risk. Second, if mining resumes, the movement of ore and equipment via city roads could cause structural damage to municipal infrastructure—a concern the council flagged as requiring proactive mitigation strategy. Lois Fruhwirth characterized the study-session presentation as "extremely informative" and framed it as necessary preparation for "next steps," suggesting the city does not yet have a definitive road-protection plan. The involvement of Chinese ownership and backing may also raise geopolitical or trade-related sensitivities not explicit in the transcript but potentially relevant to community perception.
State Legislative Preemption Threat (HB 2447 & Ongoing Efforts): During the study session, lobbyists for the city (Nick Ponder, High Ground Consulting, and Alexis of Sustain 48) presented an update on state legislative efforts to curtail local land-use authority. Lois Fruhwirth specifically cited HB 2447 (passed in 2025), which eliminated public review of community development projects and required administrative approval only. She characterized this as part of a pattern of attacks on local control and expressed concern that similar bills will continue to be introduced. She noted the irony that state legislators object to federal preemption of state authority, yet they willingly preempt municipal and county authority. The city's response has been to increase state-house engagement, update its legislative platform, and coordinate with other municipalities and agencies. However, she acknowledged that the fiscal picture in Phoenix "is not looking great" and that the prospect of state funding for local projects in fiscal 2027–2028 is "projected to be uh minimal too small in the coming year."
Nonprofit Status & Estate Planning Donations: Lois Fruhwirth highlighted that the Sierra Point LLC donation represents a rare opportunity to leverage Prescott's nonprofit status for strategic land acquisition. She noted that Aker Park came to the city through an estate-planning grant and that tax planning and estate-planning donations are underutilized tools for municipal growth. She characterized this as "a new experience for most of us" in her two and a half years on council, suggesting that the city is still developing institutional capacity to identify and facilitate such donations.
Duration
- Rodeo Master Plan discussion: Duration not specified in transcript.
- Study session topics: Two presentations (Gold Paradise Mine remediation; state legislative update). Duration not specified.
- Total meeting duration: Not stated in transcript.
Other Notable Items
November 2026 Ballot Propositions: The council discussed seven ballot propositions for the November general election. Lois Fruhwirth cautioned voters to consult supplementary materials (city publicity pamphlet, participate.prescott.gov website, and in-person forums) to understand the issues, as ballot language itself has been simplified per state statute. A city publicity pamphlet will be mailed to all registered voters' households and will include pro and con arguments paid for by council members and community members at $100 per argument. The pamphlet will also be available online. Lois Fruhwirth plans to attend the Saturday, October 3rd farmers market to discuss the propositions with voters; any council member can be requested to speak to community groups about the propositions.
The Betsy Liquor License Renewal: The restaurant/bar under new ownership requested renewal of its liquor license and approval for an expanded business model including beer and wine takeaway service. The council voted unanimously to approve, welcoming the new owners.

[music] Hi everyone, this is Mayor Prom Lois Fworth [music] and we're here once again to do in case you missed it for the council meetings of Tuesday, September 22nd. Let's start with the voting meeting and the headline discussion that happened [music] uh yesterday. We were working on the rodeo master plan. We've had public hearing process.
Um this is the second public [music] hearing and given all the input that has rolled in since our August town meeting um at the roster center all the way through now the the rodeo uh steering team [music] and GH2 has been integrating input and making little bitty adjustments but this was the final part [music] of the formal public hearing. So council did vote yesterday to close the formal public hearing [music] process.
Um, we did hear some issues or concerns were [music] expressed yesterday by uh some members of the community and the public um and the neighborhood. Um, some of those issues and concerns are [music] things that frankly we'll have to uh address as part of the lease negotiations. Um, [music] as we set those up, we have uh and some of those concerns are something that I thought yes needed [music] to be integrated um into the master plan.
So, we will be at this point [music] council scheduled to have uh a vote on the master plan [music] at our Tuesday, October 13th council meeting starting at 300 p.m. [music] And we will see at that point what's been fully integrated and um and what will be clarified would be part of lease negotiations. So, stay [music] tuned. We will absolutely allow public comment um on October [music] 13.
Another big item that we uh did yesterday as part of the voting session [music] was accept a donation of 73 acres that [music] is land adjacent to the land that [music] council purchased a few years ago to protect the public [music] when it came to possibly building homes in the area crash area of the crosswind runway. [music] So yesterday the great news was that uh Sierra Point LLC [music] um did donate uh 73 acres to the city of Prescat.
We not [music] only accepted the donation, but we also approved adopting that land [music] um into the airport master plan and into the airport area. And [music] that's really important from all sorts of federal government related reasons to have done those things. But it brought up a really good point. I thought the mayor did a nice job of highlighting is that um we actually are a nonprofit, [music] the city of Prescat.
And so, um if you have issues that you're trying to plan, tax [music] planning purposes, estate planning purposes, you know, we all know Aker Park came to [music] the city as part of a grant um estate planning. Uh so these [music] are things that can be done and the city, you know, is willing to consider taking those items in. So this was one of them yesterday. I haven't seen [music] this happen in in the two and a half years I've been on council.
So it was a new experience for [music] most of us. The final item we discussed as part of the regular agenda at the voting meeting was a discussion about the propositions, the seven propositions [music] that the city of Prescuit is putting on your ballot for the November election. It is going to be critical [music] that you do your homework and do your reading before you sit down with your ballot [music] to vote because the ballot itself, the language has been simplified per state statute.
Some of the things that we're doing like charter amendments [music] um doesn't get to have the length of explanation on the ballot that other things like [music] the county uh jail tax gets to have. So [music] unfortunately if you just look at the ballot you might not know how to vote and so want to talk about how you're going to find out where [music] how to vote. There's going to be multiple options.
First a city publicity pamphlet [music] is going to be mailed to every voter's home at least one per household that has registered city of prescuit [music] voters in it. as part of that ballot, the full ballot language is uh explanation is going to be there. Plus, in that publicity pamphlet, [music] um members of the public, even some electeds have paid $100 per argument to be able to put their arguments in the pamphlet, both uh pro and [music] conar arguments.
So, that pamphlet when it comes out, I think is going to be extremely helpful. [music] So, don't think it's junk mail. Save it. put it to the side. Uh put it near your ballot because you're going to want to have that with you. Um the other thing that we're doing is we are making sure that it is available [music] on city websites as well.
Not only the city of Prescuit website um arrow down on when you get to the homepage, there'll be [music] a section there, but also it's going to be a whole section with even some more explanations that will be available on uh participate.com. So [music] everything um should be either mailed or on its way or up on the website [music] by the end of next week. And if that isn't enough help for you, you can come to the farmers market on uh next Saturday the 3rd.
Um and I will be there with also the ballot language with me and I'm happy to answer your questions, your concerns, [music] some of the rationale as to why the council um put these items on the ballot.
And also one more thing, [music] if you have a group that you would like to have someone from the [music] city come and talk about these things, you can also reach out to any member of council and we would be happy to [music] be able to come and talk to you about the rationale as to why we in the charter committee put these [music] uh ballot propositions before you.
So hopefully you have multiple ways [music] of considering the ballots, understanding the pro and con arguments, and then [music] casting your own vote. One other item that was on the voting agenda was a uh consent ordinance for liquor [music] licenses.
And so the Betsy that has been across the street from Founding Fathers for a couple of years now [music] has new owners and they were coming forward not only to renew the liquor license, but they also [music] have a slight change in their business model and they're going to have a liquor store where you can take away wine and beer with you. So [music] um that was an unanimous vote by every member of council and welcome to the new owners of the Betsy. All right.
At the 1:00 study [music] session, there was two topics that may not interest everybody, but if you are interested in these topics, I really do think it's worth your while to uh watch the study [music] session. The first item up was we had a amazing legal [music] expert um from the Arizona Department of uh environmental quality who's all in the water area. [music] And this was regarding the gold paradise mine.
recall that is a mine um that was sold [music] to uh gold's paradise and um they are a Chinese backers um and based [music] companies and so they were doing some work and created quite an environmental mess at the foot of our Hyia River. Um ADQ has been involved in that.
they've been [music] trying to get solutions put in place and they um shared an update of where they are in that process, what uh contingency they [music] have so that if Gold Paradise doesn't fulfill the parts of the judgment, [music] um they will be also having $4 million from Gold Paradise Mine to enable ADEQ [music] to finish the cleanup. So that's all great news. Um [music] and so we discussed what's going on.
There'll be a lot more coming out through the county and other groups as well, [music] more forums as well. So, if you can't make those forums, you want to stay tuned um and understand the rationale. I found it extremely [music] informative.
It also allowed the city of Prescuit to talk about if this gold paradise does do all the remediation and finds themselves back in business [music] mining here and taking their trucks through the city of Prescuit, what recourses [music] do we have to protect the structural integrity of our roads with these heavy [music] trucks coming through.
So, more to come on those fronts, but I thought it was a really well done study session [music] um to enable us to think through what do we need to do as the next steps. So finally we ended our study [music] session with talking about uh hearing from Nick Ponder from high [music] ground and also him representing Alexis who is Sust 48. [music] They are our lobbyists that we have under contract for the city of Prescuit.
[music] They were very complimentary of the work that we've been doing over the last two years to show up more down at the [music] state house to work our issues down there to lobby. We've also met [music] with many many of the state agencies this year which was also a great ad. So he was highlighting [music] how that's been helpful. He also did like a recap of what happened overall and what he's projecting [music] as somebody who's been covering the state house for many many years.
Um his expertise what he sees probably coming [music] in the next year. One theme that's concerning um to all of us here in the city of Prescat [music] is that we've got some members down in the state house who are working really hard to continue to cut [music] our local control.
Um, and we did talk about um the the item that happened last year, HB2447, [music] which basically tied all of our hands in cities and towns from having public review [music] of um all sorts of community development related [music] projects and now they are only to be administratively approved. We've talked about that in the past. [music] That's the kind of attacks on local control.
Um, nobody in the state house [music] likes when DC tells them what to do, but we're supposed to be okay with them [music] telling us how to do our county, city, or town business. So, Nick did foresee that that is going to continue to happen. And, um, that's [music] disappointing, but it just means we have to get better and better of showing up when things matter.
Um, I do want to refer you all if you want to [music] see, we did vote in a previous meeting um, earlier this summer to update and approve a more simplified le leg legislative platform. [music] It's two pages. It outlines our legislative priorities, a little profile [music] of the city, which we use especially when we're interacting with some of the departments. Um, and we talk about some of the bills of interest and our funding priorities [music] for the upcoming fiscal 2728 or 2829.
The reality right now is [music] the picture down in in Phoenix is not looking great. Um so the chance [music] of us getting a lot of towns and cities getting any funds to do local projects is projected to be uh [music] minimal too small in the coming year but time will tell. But I do want to highlight the legislative [music] platform. If you're interested it will be available uh both on participate [music] prescuit as well as on the city website. So just look that up. 27 legislative platform.
With that, have a great weekend everyone.
